Welcome to Active Lambeth, the new name for leisure services managed and run by The London Borough of Lambeth from 1st April 2023.
In this document, you will find terms and conditions that are relevant to your use of Active Lambeth leisure services. By logging onto the Active Lambeth website, you indicate acceptance of these Terms and Conditions and agree to abide by them. Please read them carefully. If you do not agree with the Terms and Conditions included within this document, please refrain from using our website.
These Terms and Conditions replace any former applicable versions and take priority over any verbal statements communicated by Active Lambeth staff. Active Lambeth reserve the right to update these Terms and Conditions from time to time by giving reasonable notice as far in advance as reasonably possible to its Members, Customers and members of the public.

Meaning of Terms
Active Lambeth
References within these terms and conditions to “Us”, “Our” shall mean Active Lambeth.
Active Lambeth Online Portal
The online portal to be used by Members and Customer to access and manage Membership queries and book Activities.
Activities
The leisure service activities undertaken at the Facilities as provided by Active Lambeth.
Activity Booking
Means by which you can book an Activity at a Facility.
Activity Cancellation Charge
If you fail to inform us at least 3 hours before an Activity is scheduled to begin that you wish to cancel that Activity, an Activity Cancellation Charge will be applied to your Membership account in the sum of £3.00.
Activity Fee
The Fee incurred when booking or accessing Activities at one of the Facilities. The Activity Fee is non-refundable if you cancel your booking within a 3 hours of when the Activity is due to start or you do not show up for that Activity.
Admission Fee
The Fee charged to enter our Facilities if you have not paid an Activity Fee or you do not have an Active Lambeth Monthly or One-Off Payment Membership.
Assigned Leisure Centre
The leisure centre at which Your Membership is initially registered during the joining process. You can change it at the point of joining or during the Membership Period by attending one of the leisure centres in person and informing an Active Lambeth member of staff.
Bookings in Blocks
Activities that are reserved for a specific period of time and are paid for in one single payment in advance.
Cooling Off Period
The period of 14 days after the Start Date of your Membership.
Customer
An individual or member of the public who is not usually a Member who is permitted to attend the Facilities to take part in an Activity.
Cut Off Date
The date up until changes can be made to your Direct Debit payment.
Data Protection Legislation
All applicable data protection and privacy legislation in force from time to time in the UK including UK GDPR; the Data Protection Act 2018 (DPA 2018) (and regulations made thereunder) and the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended and the guidance and codes of practice issued by the Information Commissioner or other relevant regulatory authority and applicable to a party.
Direct Debit
The payment taken for Services provided by Active Lambeth from your bank account on a day agreed with you. The monthly direct debit requests constitute a binding contract between you and us and will automatically continue until you notify us otherwise.
Exception in Circumstances
When it is no longer reasonable for you to use the Active Lambeth Facilities or remain a Member and you need to terminate your Membership early. For example:
- if you are suffering from a medical condition or significant illness (not including pregnancy but does include a medical condition arising from that pregnancy) which stops you from using your Assigned Leisure Centre;
- if you experience a significant injury which stops you from using your Assigned Leisure Centre;
- loss of employment;
- you are being relocated to a location that is more than 10 miles from your Assigned Leisure Centre and you cannot reasonably be expected to use your Assigned Leisure Centre or an alternative Active Lambeth Facility;
or any other circumstances other than those listed above that you may be able to demonstrate to our reasonable satisfaction is exceptional and may require early termination of your Membership.
Facilities
The leisure centres, buildings and other facilities where the Activities are to be provided as specified by Active Lambeth from time to time.
Fees
The charges levied on Members by Active Lambeth for Membership for using the Facilities
Lessons and Courses
A scheduled supervised Activity available to Members and Customers which can be undertaken at our Facilities.
Member(s)
Those individuals who have obtained a Membership for use at our Facilities or are entitled to use the Facilities and/or engage in the Activities from time to time. For any individual under 16 years old we require permission from the person who has parental responsibility for that child before they can use the Facilities.
Membership
An individual who has gone through the Active Lambeth membership joining process, paid the necessary Fees and been issued with a Membership card number to enable them to participate in the Activities at the various Facilities.
Membership Pause
Where Active Lambeth agrees to your Membership being temporarily paused for a period of up to 3 months due to a prolonged absence such as serious illness or injury. Once the Pause period ends, Your Monthly Payments and access to Facilities will automatically resume.
Membership Period
The period commencing on the Start Date of your Membership and ending on the date your Membership expires.
Month In Hand
When you pay by Direct Debit for some Lessons or Courses, you will have to make an additional non-refundable payment. This payment is equal to one Monthly Payment Fee. It does not affect your first Direct Debit payment. Should you decide to cancel your Membership, you will be entitled to an additional month of access to Facilities without paying a Monthly Payment Fee.
Monthly Member/Membership
An individual who pays to use our Facilities by making monthly in advance direct debit payments.
Monthly Payment Fee
An individual who pays in advance by way of monthly payments to use a range of Activities at our Facilities.
No Show Charge
The Fee charged by Active Lambeth for non-attendance and failure to cancel an Activity in advance.
One-Off Payment Member/Membership
An individual who pays to use our Facilities for a fixed-term by making one annual payment in advance.
Pay and Play
Activities paid for on a ‘pay as you go’ basis.
Pro-Rata Fee
The Fees calculated at the Start Date which accrue before the first Direct Debit is taken.
Rules
Any applicable rules, regulations, guidance, directions and legislation with which Active Lambeth are bound to comply with.
Set Up Fee
The set up and activation fee for a Monthly or One-Off Payment Membership is £10, subject to revision and adjustment.
Start Date
The date on which your Membership starts. This is usually the date of signing up to join Active Lambeth as a Member after which time you are bound by our applicable terms and conditions.
1. MEMBERSHIP
1.1. Active Lambeth will inform each Member of their Assigned Leisure Centre upon acceptance of an application for Membership. You are responsible for informing us if you want to change your Assigned Leisure Centre. Please refer to clause 6 (Membership Changes).
1.2. You are required to show valid proof of your Membership every time you visit our Facilities otherwise you may be denied access. If you lose your Membership card, a replacement will be made available to you for a nominal fee.
1.3. Proof of eligibility will be required for certain Memberships from time to time. This can be done by uploading the required information online or in person by visiting your Assigned Leisure Centre. You are obliged to inform us of any changes in your circumstances that might affect your Membership.
1.4. Active Lambeth reserves the right to cancel your Membership with no opportunity of a refund of the initial Fees paid, where proof of eligibility is not provided by you within 7 days of the Start Date of your Membership.
1.5. Not all Memberships offer the same level of benefits. Before submitting your Membership application, you should check the benefits, facilities, and activities that are included and excluded. You can see these details by selecting the Membership type in Step 2 of the purchase process and clicking “View Details”.
1.6. You must always use the Facilities in accordance with your level of Membership. A Member found to be participating in an Activity at one of our Facilities which is not included within their Membership entitlement will be required to secure a valid booking and pay for that Activity at the appropriate rate.
1.7. As a Member, you will be given an identifying personal Membership number when joining that only you can use. Membership cards are non-transferable. Where a Member is found to have allowed another person to access Facilities and participate in the Activities available under their Membership, Active Lambeth reserves the right to cancel the Membership at our sole discretion without refunding any Fees or paying any compensation. Further, we will not consider any applications for Membership from you for at least 12 months from the date your Membership was cancelled.
1.8. At the Start Date of your Membership Period, you will be required to pay the relevant Fees as advised by Active Lambeth staff. The details are dependent on the type of Membership you are applying for.
1.9. All Memberships are subject to a cooling off period. Please be aware that if you decide for any reason not to continue with your Membership, you will need to notify us within 14 days of the Start Date to avoid being charged. As long as you have not waived your right to cancel by using the Facilities during this period, all Fees paid in advance will be refunded.
2. Membership Categories
Monthly Membership
2.1. Monthly Members are required to pay monthly in advance by Direct Debit. You can specify which day of the month the Direct Debit will be collected.
2.2. You can amend your Monthly Membership by completing our online form. You can find it by visiting our website at active.lambeth.gov.uk or by emailing ActiveLambeth@lambeth.gov.uk To enable us to amend your Membership before your next Direct Debit is due to be collected, you will need to provide a minimum of 1 calendar months’ notice.
2.3. You must follow the process outlined to upgrade or downgrade your Monthly Membership as outlined in clause 2.4. If you upgrade, you may be required to pay a Pro-Rata Fee to cover the costs of the change before your next Direct Debit payment is processed.
2.4. Through the Active Lambeth Online Portal or Active Lambeth App, you can cancel your Monthly Membership by selecting ‘My Account’, ‘Memberships’, ‘Manage Membership’, then ‘Cancel Membership’. To avoid any further Direct Debit payments being collected, you must give us at least 20 calendar days’ notice
2.5. To cancel Your Monthly Membership, you can either send a letter to Active Lambeth’s postal address as mentioned in the ‘Managing Contact’ section of these Terms and Conditions clearly marked “Membership Cancellation” or email us at: ActiveLambeth@lambeth.gov.uk To avoid any further Direct Debit payments being collected, you must give us at least 1 calendar months’ notice before the date of that your next Direct Debit is due to be collected.
2.6. In the event that cancellations are made prior to the cut-off dates of 20 days or 1 calendar month, no further Direct Debit collections will be made until the next Direct Debit collection date.
2.7. The date on which the next Direct Debit collection is due will serve as the date that will be used to collect one final Direct Debit if the cancellation is received after the Cut Off Dates.
2.8. If We make significant changes to the Activities and Facilities covered by the Membership, such as implementing price increases affecting your Membership, you have the right to cancel your Membership. When we cannot provide you with 1 calendar month’s notice of any price increases and you decide to cancel, you may do so by giving us 1 calendar months’ written notice either by post or email. It is your responsibility to pay all the applicable Fees will continue until the date before the increase takes effect.
2.9. If the issue of a Month In Hand payment becomes relevant, you will be entitled to free use of the Facilities based on the provisions contained within clauses 2.2 – 2.5 for the whole month of cancellation.
One-Off Payment Membership
2.10. Failure to renew your One-Off Payment Membership before it expires will lead to the Membership automatically terminating and a Set Up Fee will be payable to re-join.
2.11. To cancel your One-Off Payment Membership, select ‘My Account’, then “Memberships”, then “Manage Membership”, then “Cancel”. Fees will only be refunded in accordance with the process described in clause 2.12 below.
2.12. A One-Off Payment Membership refund will only be granted if there is a change in your personal circumstances amounting to an Exception in Circumstances. Where an Exception in Circumstances occurs, you must provide us with written notification and proof of the Exception in Circumstances. We will then consider your request and if we are satisfied that there has been an Exception in Circumstances that applies to you, your refund will be processed in accordance with clause 2.13 below. The decision to issue a refund where an Exception in Circumstances occurs is at the sole discretion of Active Lambeth.
2.13. Where an Exception in Circumstances occurs it may lead to the cancellation of a One-Off Payment Membership. You will be charged at the Monthly Payment Fee rate for the portion of the year prior to cancellation, and we’ll refund you the balance within 30 days. For instance, if your One-Off Payment Membership cost £300 a year and you give us notice of cancellation within a 6-month period, we will refund you £150.
Pay and Play
2.14. Cooling Off Periods are not available to those individuals paying for Activities on a Pay and Play basis.
Booking in Blocks
2.15. Booking in Blocks can be cancelled at any time during your Membership Period and any Fees paid will be non-refundable.
Membership Pause
2.16. Your Monthly Membership may be paused if you are temporarily unable to continue participating due to medical reasons or pregnancy. The pause will be activated when we receive proof of your request. The decision to accept your request is at Active Lambeth’s sole discretion.
2.17. You may request that your Membership is paused due to a medical condition or pregnancy. If we agree to your request, the pause will be activated on the date the proof is received.
2.18. In the Active Lambeth Online Portal or Active Lambeth App, you can pause your membership by selecting ‘My Account’ then ‘Memberships’ then ‘Manage Membership’ and then ‘Pause Membership’. You can select a pause period based on the reason you select.
2.19. After the period for the Membership Pause has expired, the Membership will automatically be reinstated, and Fees will be collected by us again.
2.20. If you wish to end the Membership Pause sooner, you may do so via active.lambeth.gov.uk
2.21. We may consider implementing a Membership Pause for reasons other than for a medical condition for a maximum period of 3 months at our sole discretion. If you wish to be considered for a Membership Pause, you must apply in writing to your Assigned Leisure Centre or online via the Active Lambeth Online Portal within one-year of the Start Date of you Membership. To apply for a Membership Pause, you will need to provide proof by way of supporting documents. Please ask a member of Active Lambeth staff for more details. A nominal ‘Pause Fee’ may apply to non-medical Membership Pauses.
2.22. Any Membership Pause that applies to a One-Off Payment Membership will not be included in the Membership Period. When the One-Off Payment Membership is reactivated, any time remaining of the Membership Period will still be available for use. For instance, a 6-month remaining term will result in 6-months of the term to run once the Membership Pause had expired.
2.23. In the event of a Membership Pause for Lessons and Courses, the pupil will be removed from the lesson until they are ready to return and we will do our best to find a similar time and day, but we cannot guarantee this.
3. Payment of Fees
3.1. It is your responsibility to pay your Membership Fees throughout the Membership Period, regardless of whether you use the Facilities or not unless you are subject to a Membership Pause or your Membership has been cancelled in accordance with the provisions set out in clause 6 (Membership Changes).
3.2. A Set Up Fee will apply to some Memberships (unless waived as part of a promotional offer).
3.3. The online Monthly and One-Off Payment Memberships are subject to a Set Up Fee, Pro-Rata Fee and a Monthly Payment Fee (unless waived in a promotional offer).
3.4. The cost of your One-Off Payment Membership is due in advance and will last for 12 months.
3.5. Fees paid in advance are non-refundable unless they are subject to the cancellation provisions within clause 6 (Membership Changes).
3.6. Where you fail to pay the required Fees during the Membership Period, Active Lambeth reserves the right to cancel or suspend your Membership immediately.
3.7. If your existing One-Off Payment Membership expires without being renewed, or if a Monthly Payment Fee is missed, you will need to purchase a new Membership in order to continue using the Facilities. New Memberships will be subject to the usual Set Up Fee and Pro-Rata Fee.
3.8. If your Membership account falls into arrears, the failure to make any outstanding Membership Payment(s) will initially lead Active Lambeth to remove your access to Membership benefits until all outstanding payments are made to clear any debt arising. We reserve the right to cancel your Membership and take further legal action to formally recover all outstanding balances.
3.9. Our Fees are reviewed periodically and at least once a year. If Your Fees are paid by Direct Debit and are due to change, we will notify you by email at least 10 working days in advance of when the new Fees are due to be implemented.
4. General Conditions of Use
4.1. All Activities and Facilities provided by Active Lambeth are subject to the following:
4.1.1. Your adherence to the Rules relating to that particular Facility as well as any other Rules applicable to that Activity at all times;
4.1.2. Your agreement that your use of the Facilities and availability of Activities may be restricted from time to time due to changes in session times to accommodate exclusive sessions for beginners, experienced users, women, children, people with disabilities, and older people. In addition, we may need to close our Facilities during special events and activities should the need arise. Your Fees will not be adjusted in these circumstances;
4.1.3. Your acknowledgement of procedures for safe operation in relation to the capacity of the Facility;
4.1.4. Your agreement to dress appropriately for the Activity you are undertaking.
4.2. Our interpretation of the Rules will always take precedence and the Active Lambeth’s Facility Manager or his / her nominee’s final decision must be adhered to.
4.3. The following are the rights of our Active Lambeth staff:
4.3.1. Deny entry to any individual;
4.3.2. Request that you and anyone associated with you leave the Facility;
4.3.3. Deny you and anyone associated with you, future access to all of Active Lambeth’s Facilities at their sole discretion in the future.
4.4. We may take such action where you or anyone associated with you fail to follow these Rules or where an Active Lambeth Facility Manager deems it appropriate.
4.5. If You are excluded from future use of Active Lambeth Facilities your Membership will be terminated immediately. You will not receive a refund of any Fees paid for or in connection with your Membership.
4.6. At any time, we may be required to postpone, alter, cancel, or introduce new Activities for any reason, including customer feedback. We may withdraw equipment and/or Facilities for maintenance, repair, and alteration, among other reasons. In the event that such a change occurs, we will notify you by posting notices in the Facility, on our website or by contacting you by email as far in advance as possible.
4.7. In the event that the Facilities are unavailable, whether or not this is caused by the programming of activities and classes, we will not reduce or refund any Fees. However, in the event that we make a significant change, you may cancel your Membership clause 6 (Membership Changes), in accordance with the cancellation provisions.
4.8. Where we cancel a lesson or course for which you have paid in advance, you may use an equivalent amount of credit to access a similar lesson or course at an alternative time, or day in the next 8 weeks. The next Monthly Membership payment taken by us will be reduced by the value of the cancelled lesson or course if no similar lesson or course is available.
4.9. Members may use lockers located at our Facilities under the following conditions:
4.9.1. Locker keys must not be taken away from the Facility where the locker is located;
4.9.2. We have the right to enter any locker at any time in cases of emergencies and necessity. We may empty the lockers at night without giving you prior notice. You can claim any item removed from our lockers for up to 1 month after we removed them. After this time, the items will be either donated to charity or disposed of and we will not accept any responsibility for them;
4.9.3. Locks secured with a padlock not authorised by Active Lambeth will be removed each night. In the event that the padlock is removed, we do not accept liability for any costs arising;
4.9.4. You are not permitted to store any illegal goods, weapons, perishable goods, toxic, polluted or contaminated goods, flammable, hazardous or living items in the lockers at any time;
4.9.5. You bring any valuable items into our Facility and / or store them in lockers at your own risk. We do not accept legal responsibility for any loss or damage to these items.
4.10. You will not be allowed to enter or participate in an Activity at any Active Lambeth Facility if you are deemed by our staff to be under the influence of alcohol or drugs.
4.11. We will consider the appropriate adjustments we can reasonably make if you inform us that you have a disability which puts you at a substantial disadvantage in accessing our equipment and Facilities.
4.12. We do not allow animals into our Facilities (with the exception of assistance dogs).
4.13. Smoking, vaping, or the use of e-cigarettes are not permitted in any of our Facilities or in the immediate vicinity of any of our Facilities’ premises.
4.14. You are required to adhere to all health and safety signs in and around the exterior of our Facilities. If you have any queries regarding any health and safety sign, you are required to speak to a member of Active Lambeth staff.
5. General Booking Conditions
5.1. Prior to attending any Active Lambeth Facility we actively encourage Members and Customers to pre book and pay for their Activity in advance.
5.2. To pre-book an Activity, please log onto our Active Lambeth App, online at active.lambeth.gov.uk or telephone the Active Lambeth Customer Service Team or Facility on 02070955100
5.3. Alternatively, Members can book Activities in person with one of the Active Lambeth staff members at the concierge desk located at their Assigned Leisure Centre.
5.4. Where you book an Activity which is not included within your Membership benefits, you will be required to pay the full Fee in accordance with our charges at that time. This is referred to as Pay and Play. You will need to show proof of a valid Active Lambeth Membership at the time of booking to ensure the correct price is applied to your booking.
5.5. Bookings can be made up to 7 days in advance for Pay and Play Activities by those with a current One-Off Payment Membership or other Direct Debit Membership. Bookings can be made up to 6 days in advance for Pay and Play Activities by non-Members.
5.6. All Activity bookings are subject to availability at the time of booking. Active Lambeth does not guarantee the availability of courts, classes, Lessons and Courses or sessions as these are on a ‘first come, first served’ basis.
5.7. Where bookings are made via a member of the Active Lambeth Customer Service Team, a series of security questions will be asked to determine appropriate use of the Active Lambeth Membership and ensure personal data security.
5.8. For court hire, Members and Customers have the right to cancel, modify or transfer the booking if this is undertaken more than 24 hours in advance of the booked Activity. No refunds will be given where cancellation is made within 24 hours of the booked Activity. Any request to transfer or refund a booking within the specified 24 hour period is at Active Lambeth’s discretion and will not be honoured unless a valid doctor’s certificate is produced or proof of injury is evident.
5.9. For Lessons and Courses for example swim sessions, a minimum of 3 hours’ notice of cancellation is required.
5.10. In the event of severe weather or serious incident, where the Facility remains open and is staffed and ready for use by members of the public, a refund or transfer will not be granted.
5.11. Multiple court bookings are not permitted at the same time unless the same Active Lambeth Account is used and the bookings are fully paid for in advance.
5.12. A booking for an Activity made in an individual person’s name cannot be substituted for anyone else.
5.13. We have the right to withdraw or cancel Activities offered at our Facilities from time to time for repairs, refurbishment, tournaments or special events or other closures beyond our reasonable control such as government restrictions. If we decide to withdraw or cancel Activities, we will make every reasonable effort to let you know by giving you at least 1 or 2 weeks’ notice in writing of any disruption to the regular programme. Where this results in cancellation of a paid session and access to a similar Activity is unavailable at another of our Facilities on your required date and at your required time, we will refund you in full or give you a credit note for that Activity which you can use at an alternative time. There is no entitlement to a full refund where Facilities are withdrawn or cancelled due to reasons beyond our reasonable control. However, refunds may be given at Active Lambeth’s sole discretion.
5.14. Opening times of all Facilities will be limited over Bank Holiday periods. Generally, a Facility will be open except for statutory bank holidays, including Christmas Day, Boxing Day and New Year’s Day.
5.15. Some Activities are for single sex participants. Where possible, these Activities are programmed so that the Activity can be accessed by anyone at an alternative Facility.
5.16. Active Lambeth reserve the right to change or cancel a programme of Activities without prior notification as the Activity may be deemed no longer viable.
5.17. We recommend that you cancel your booking via the Active Lambeth App or Active Lambeth Online Portal. Alternatively, you can cancel in person at your Assigned Leisure Centre.
Late Cancellation and Non-Attendance for Pre-booked Activities.
5.18. This applies to the following Activities: Public Swimming, Fitness Classes, and Spin, court bookings and other bookable Activities.
5.19. Where a Member fails to attend for a pre booked Activity or cancels with less than 3 hours’ notice of the session start time and therefore prevents other Members accessing a session a £3.00 penalty fee will be charged to maximise spaces for all our Members. The No Show Charges for late cancellations will be recorded on your Membership record, and you will not be able to use the Facilities or make further bookings until these charges are paid in full. You can pay No Show Charge either online using the Active Lambeth App or Active Lambeth Online Portal or in person at the concierge desk at your Assigned Leisure Centre.
Waiting lists
5.20. Waiting lists are available for most classes and sessions so that when people cancel a class or session, those on a waiting list receive an automated e-mail with a direct link for them to book onto the class. We operate a 7 day advance booking window with spaces for most classes and sessions available on a first come first served basis.
6. Membership Changes
6.1. It is your responsibility to ensure that your Membership details are kept up-to-date. You can do this yourself by accessing the Active Lambeth Online Portal and Active Lambeth App, or you can contact our Active Lambeth Customer Service Team by emailing ActiveLambeth@lambeth.gov.uk
6.2. You can change your bank details by contacting us via Our “Contact Us” form on our active.lambeth.gov.uk or by visiting your Assigned Leisure Centre.
6.3. Before any changes can be made to your Membership or a Membership for which you pay, you will need to provide proof of your identity.
6.4. You may request a change to your Membership type or Assigned Leisure Centre at any time by contacting us through our “Contact Us” form on our website at active.lambeth.gov.uk or in person at your Assigned Leisure Centre. You will be required to pay all Fees associated with the new Membership, and the amount will vary accordingly.
6.5. Refund requests will be handled in accordance with these Terms and Conditions and in accordance with the type of Membership you have.
7. Photographs and Videos
7.1. At our Facilities, photography, videoing, filming or any type of recording of images or sound is prohibited without first obtaining permission from the Facility Manager. It is at the Active Lambeth staff’s discretion at the Facilities to decide whether such recording of Activities are appropriate or permitted.
7.2. You must not take photographs or videos of any children under 18 years old other than your own. If you want to take photographic images and recordings of other individuals, you must ask and receive their express permission or by implicit consent (for example, your own children or family members). In the case of children under 18 years old, you must receive the express permission of their parent or guardian.
7.3. Anyone appearing in your photographs or videos must be made aware that they are being filmed and you must obtain their permission first.
7.4. You must not take any photographs or videos in the changing areas, sauna, steam room, health suites, spa, toilet, children’s play area, nursery, creche facility or any other area deemed to be inappropriate on any of our Facilities’ premises.
7.5. When requested, the Facility Manager may allow you to take occasional photos or videos, but any formal or more extensive filming or photography must be approved in writing by the Facility Manager in advance.
7.6. If we receive information from a member of the public at our Facility that you are filming and they lodge a complaint, we may ask you to show us the images you have recorded and delete them if appropriate.
7.7. If an Active Lambeth member of staff asks you to stop filming or taking photographs you must do so immediately.
8. Children
8.1. Whilst in any of our Facilities, children under the age of 8 years must be supervised by an appropriate adult over the age of 18 years old unless they are taking part in a supervised Activity organised by us where parents and guardians are not required to be present.
8.2. When attending Lessons and Courses or other supervised Activity, children under 8 years old must be accompanied by an appropriate adult and accompanied to the designated meeting point for that Activity. Prior to starting the Lesson or Course or other supervised Activity, they will be handed over directly to the Active Lambeth member of staff who is teaching or coaching within the Activity area. Meeting points are clearly marked on a board stating, ‘Activity Lesson Meeting Point’. When the Lesson or Course or other supervised Activity ends, the appropriate adult must be present to pick up their children.
8.3. All Active Lambeth staff are required to be DBS checked.
8.4. Children aged 15 years old and under must not use the sauna, steam room or spa unaccompanied.

9. DATA PROTECTION
9.1. We are responsible for ensuring that your privacy rights, including your right to access your data and to ask for it to be rectified, erased, or restricted from use, are upheld as the Data Controller of the Personal Data we hold about you. In order to exercise your rights, please contact ActiveLambeth@lambeth.gov.uk.
9.2. As part of providing our Activities, managing and administering your Membership, conducting financial audits, and responding to financial queries, We must process the personal data you provide in your Membership application and the data we collect about your usage of our Facilities.
9.3. You may withdraw your consent for special category data processing at any time. See our privacy notice on our website for more information. 9.4. We automatically delete your personal data 2 years after the Membership expires or is cancelled, or 2 years after the last Membership benefit usage.
10. Liability
10.1. Active Lambeth does not accept liability for damage or loss to your property or your guests’ property that may occur while you are on the Facility premises or area surrounding the Facility premises, other than liability arising from our negligence or our failure to take reasonable care.
10.2. Active Lambeth does not accept liability for the injury or death of any Member, Customer or other member of the public that occurs on the Facility premises or area surrounding the Facility premises, other than the liability arising from our negligence or our failure to take reasonable care.
10.3. Nothing within these Terms and Conditions is intended to limit your rights under Consumer Law.
11. Commitment Statements
Active Lambeth’s Commitment to YOU:
11.1. Active Lambeth will respect your personal choice and any decisions you make about the level of Activity you undertake.
11.2. We will take reasonable steps to ensure that our equipment and Facilities are clean, safe and fit for purpose by our Customers, Members and members of the public.
11.3. We will take reasonable steps to ensure that our staff have the necessary experience, skills, ability and qualifications prevailing in the leisure services industry.
YOUR Commitment to Active Lambeth:
11.4. You are deemed to be fit and healthy by participating in the Activities at our Facilities offered by Active Lambeth.
11.5. If You are participating in any physical activity, you are responsible for monitoring your own health and contacting an Active Lambeth member of staff if you start to feel unwell.
11.6. If you suffer an accident or are injured at one of our Facilities, you must immediately report it to an Active Lambeth staff member or the Facility Manager and tell us the circumstances under which it occurred immediately.
11.7. You will behave respectfully and politely and dress appropriately at all times. We reserve the right to ask you to leave our Facilities if in our sole opinion, we believe your behaviour or appearance is unsuitable.
11.8. You agree to follow any reasonable instructions to allow you to exercise safely if you have a disability.
11.9. Induction training and instructions must be followed when using the equipment and Facilities. You must not use the same in any way that constitutes a health and safety risk to you or others. Our liability is limited to any injury or loss suffered by you as a result of your misuse of any equipment or any pre-existing health conditions that you may have.
11.10. You will not enter any of our Facilities if you know you are suffering with an infectious illness or disease.
YOUR Health Commitment Statement
11.11. Exercise carries its own risks, so you should never exercise more than you are capable of because your health is your responsibility you should be aware of your personal tolerance and fitness. Before participating in an Activity, speak with your doctor if you have any doubts about your fitness or if you have any medical conditions that may affect your safety.
11.12. Before starting to use the gym, we ask that you undertake a supervised gym induction session with one of the qualitied personal trainers who can assess your skills and fitness.
11.13. By engaging in physical activity at any Active Lambeth Facility, you are agreeing to the following statement regarding your health:
Before I commit to a programme of physical activity, I confirm that I am free of any health issues that could hinder or adversely affect my participation. I will seek advice and clearance from my doctor or other relevant health professional if my health status changes.
12. GENERAL
12.1. If we revise and/or change these Terms and Conditions at any time, we will give reasonable notice as far in advance as reasonably possible. Members, Customers and members of the public will be notified of updates to the Terms and Conditions by way of displayed notices at the Facilities and if you have provided an email address, we will use it as the primary method of communication.
12.2. If you fail to comply with these Terms and Conditions and any other terms and conditions provided by Active Lambeth by which govern the way in which are Services are run, we reserve the right to refuse you entry into our Facilities, reject your application for Membership and withdraw your Membership outright. Refunds will not be issued where the Member, Customer or member of the public breaches these Terms and Conditions.
12.3. These Terms and Conditions shall be governed and construed in accordance with the laws of England. Any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are exclusively subject to the jurisdiction of the courts of England.
12.4. These Terms (or part of them) will be deemed invalid, illegal or unenforceable if any court or competent authority finds any provision (or part of it) invalid, illegal or unenforceable to the extent necessary, and the other provisions of these Terms will remain valid and enforceable.
12.5. In the event that we fail to enforce any provision of these Terms and Conditions, we will not waive the right to enforce that provision or any other provision in the future. Failure to do so will not constitute a waiver of any prior or subsequent breach and shall not constitute a continuing waiver.
12.6. No rights shall accrue to anyone who is not a party to these Terms.
